Welcome to Optimous.AI ("Optimous", "we", "us", "our"), a platform for real-time audio-reactive visual experiences owned and operated by Optimal Anarchy, Corp., a California corporation. By creating an account or using any part of the service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the platform.
You must be at least 13 years old to use Optimous. If you are under 18, you represent that you have your parent or legal guardian's permission to use the service. Users who upload copyrighted audio content represent that they are at least 18 years old or have reached the age of majority in their jurisdiction.
By using Optimous you represent and warrant that you meet these eligibility requirements and that all information you provide is accurate and current.
Subject to your compliance with these Terms, Optimous grants you a limited, non-exclusive, non-transferable, revocable license to access and use the platform for your personal or internal business purposes.
You may not sublicense, sell, resell, transfer, assign, or otherwise commercially exploit or make available to any third party the platform or your access to it without our express written consent.
You retain all right, title, and interest in any audio files, project configurations, and visual outputs you create using Optimous ("Your Content"). By uploading or creating content on the platform, you grant Optimous a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display Your Content solely as necessary to provide and improve the service.
You represent and warrant that: (a) you own Your Content or have all necessary rights to upload and use it on the platform; (b) Your Content does not infringe the intellectual property, privacy, or other rights of any third party; and (c) you have all required licenses, clearances, or permissions for any music or audio you upload, including mechanical and synchronization rights where applicable.
We do not claim ownership of Your Content. We do not use your audio uploads or project data to train AI models.
You agree not to use Optimous to:
Violation of these rules may result in immediate suspension or permanent termination of your account and forfeiture of any unused credits, at our sole discretion.
Optimous respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on the platform infringes your copyright, please send a notice to our designated agent at:

Your notice must include: identification of the copyrighted work; identification of the infringing material and its location; your contact information; a good-faith belief statement; and a statement of accuracy under penalty of perjury, signed by the copyright owner or authorized agent.
Credits are a virtual currency used to access compute-intensive features on the platform. Credits are purchased in exchange for real money and have no cash value. All credit purchases are final and non-refundable unless required by applicable law.
Unused credits expire 12 months after the date of purchase. We will make reasonable efforts to notify you before expiration. We reserve the right to modify credit pricing, features, and expiration policies with reasonable advance notice.
Payment processing is handled exclusively by Paddle, who acts as the Merchant of Record for all transactions. By making a purchase you also agree to Paddle's terms of service. All billing, tax, and compliance obligations are managed by Paddle on our behalf.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the platform will be uninterrupted, error-free, or free of harmful components, or that any outputs will meet your requirements or expectations.
TO THE FULLEST EXTENT PERMITTED BY LAW, OPTIMAL ANARCHY, CORP. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.
To the fullest extent permitted by applicable law, our total liability to you is zero. All credit purchases are final and non-refundable as stated in Section 7, and no claim arising from your use of the platform shall give rise to any monetary recovery against Optimous or Optimal Anarchy, Corp.
These Terms are governed by the laws of the State of California, without regard to conflict-of-law provisions. Any dispute arising from these Terms or your use of the platform shall be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You waive any right to participate in a class action lawsuit or class-wide arbitration.
Either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Los Angeles County, California to prevent irreparable harm pending arbitration.
We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page and, for material changes, notify you by email or via an in-app notice at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes your acceptance of the updated Terms.
